To ensure you receive the freshest fruit, we endeavour to dispatch your order on the same day for 24-48hr delivery to England, Scotland and Wales providing you place your order with us by 1pm.



No deliveries are made on Saturdays, Sundays, Mondays, Bank holidays, and day after a bank holiday.  Orders received after 1pm on Thursday & any orders received on Friday Saturday, Sundays & Public holidays will be dispatched on the next working day for 24-48hr delivery.

All deliveries must be signed for. If the recipient is not available at the time of delivery a card will be left by the courier company to arrange collection from their local depot. It is than the responsibility of the recipient to re-arrange delivery/collection. No refunds will be made if the goods are not collected or a delay in collection.

Any special delivery instructions e.g. leave with neighbour must be specified at the time of placing an order. If possible please include a contact number for the recipient

It is the responsibility of the customer placing the order to ensure the recipient is available at the specified address to accept delivery for the chosen date.

Fruit4u.com will not be held responsible if an attempt for delivery has been made & the recipient is not available.

All responsibility is with recipient/third party once the fruit basket is delivered, signed and accepted.

We do not deliver to P O Box addresses.

Deliveries are made to the relevant reception area for all orders sent to hospitals, nursing homes, work place, colleges, universities and military/government buildings. Please clearly state the department/ward for all deliveries to any such places at the time of placing an order.

All responsibility for the goods is passed on to any third party i.e. neighbour, reception, security guard who sign and accept delivery on behalf of the recipient and is regarded as proof of deliver.

It is the responsibility of the customer placing the order to ensure all delivery details are fully completed and are accurate. Incorrect or insufficient delivery details will result in a delay or non delivery of the goods.

Fruit4u.com will not be held responsible if delivery cannot be made in any such circumstances and regret we cannot offer a refund or a replacement. However, we will endeavour to contact the customer as soon as possible to re-arrange delivery.

Please ensure before placing an order that the recipient is available to accept & sign for the basket on the day specified for delivery.

Fruit4u.com only use reputable courier companies to delivery your basket, if requested we can track your order for you, please contact us for further information on this.

We advise you to order early for peak times i.e. Christmas, Easter, Mothers Day, Fathers Day and Valentines Day.

TERMS AND CONDITIONS

1. Interpretation
In these Terms and Conditions ( Terms ), the following words and phrases shall have the following meanings:
“the Buyer” means the person, firm or company who purchases the Goods from the Company via the website, email, fax or phone:
“the recipient” means the person who receives the goods from the company as specified by the buyer:
“the Company” means Fruit4u.com
“Contract” means the contract of sale between the Company and the Buyer which shall be deemed to incorporate these Terms;
“Goods” means fruit baskets & gifts available to purchase on this website as agreed in the Contract to be supplied by the Company to the Buyer;
“Place of Delivery” means the place to which the Goods are to be delivered as specified by the buyer at time of placing an order.
In these Terms, reference to any statute or statutory provision shall be construed as a reference to such statute or statutory provision as amended, modified, re-enacted or replaced from time-to-time.
On receipt of written order confirmation by email or fax from the company the buyer is bound by this contract of sale.
The company has the right to amend these terms & conditions at any time without giving prior notice.

2. The Contract
The Contract shall be on these Terms & the terms of delivery to the exclusion of all other terms and conditions, including any such terms and conditions that are purported to be included or applied by the company.
No terms and conditions contained in the confirmation of order, purchase order or other document of the Buyer will form part of the Contract.
By purchasing from the company either by phone, email, and fax or via the website the buyer agrees to these terms and conditions.

3. Delivery
any dates specified by the Company for delivery of the Goods are intended to be an estimate only. If no date is specified for delivery of the Goods, delivery shall be within a reasonable time as specified in our delivery terms & conditions.
Subject to the other provisions of these Terms, the Company shall not be liable for any loss, whether direct or consequential, economic, or loss of enjoyment or loss of profits or otherwise, arising directly or indirectly out of any delay in the delivery of the Goods nor will any delay entitle the Buyer to terminate or rescind the Contract unless the delay exceeds 72 hours.

4. Price
the price for the Goods shall, unless otherwise agreed, be the price set out on this website. The price for the Goods shall be inclusive of carriage.

5. Payment
Subject to paragraph 4, payment of the price of the Goods shall be due at the time of placing an order by credit or debit card. All credit and debit card payments are processed by WORLDPAY part of RBS using a secure server.
Payment can be made by cheque. Goods will be dispatched once the cheque has cleared. Please order in advance of 7 days for orders paid by cheque.
Payment shall not be deemed to have taken place until the receipt by the Company of cleared funds. Confirmation email is sent once funds are cleared to confirm order is been processed.
The goods remain the property of Fruit4u.com until paid in full

6. Returns
Our goods are subject to a permanent quality control check. In case you have any complaints, kindly return the package to us within 7 days and we will either replace it or offer you a full a refund.


7. Cancellation policy
In accordance with the distance selling act 2000 we are exempt from giving buyers the right to cancel as the goods are perishable. However as a gesture of goodwill we will refund any orders before delivery depending on the circumstances of each case and at the discretion of the company Directors. We regret we cannot offer a refund after delivery.
All goods are subject to availability depending on season we have the right to substitute any goods to same or higher value.

8. Warranties
Any persons using this website do so at their own risk. The Company gives no warranties as to the operation of this website of any kind including and not limited to representations, software, third party links, content, information, or products therein.
The company is not liable for the loss or damage arising from the use of this website including but not limited to consequential, incidental whether the loss or damage is direct or indirect.
The company accepts no liability for links to third party sites. Users accessing third party links do so at their own risk.
The Company warrants that the Goods are of satisfactory quality.
If the Buyer wishes to make a claim under this warranty, the Buyer shall immediately contact the company of the discovery of the defect and return the goods to the Company to inspect the Goods in question within 48hrs.
The Company shall not be liable for any breach of warranty if the Buyer makes any further use of the Goods after giving such notice or alters the Goods without the agreement of the Company. The company will not be liable for any consequential losses which may be claimed.
The Company’s liability under the warranty shall be limited to replacing the Goods in question. This does not affect your statutory rights.

9. Force Majeure
If either party is subject to an event of Force Majeure, that is circumstances outside its reasonable control, including but not limited to war, fire, industrial disputes or civil commotion, it shall notify the other and the first party’s obligations under these Terms shall be suspended until it notifies the other party of the end of such event of Force Majeure.

10. General
If any part of these Terms is found to be void or unenforceable by any Court of competent jurisdiction, such part shall be severed from these Terms which will otherwise remain in full force and effect.

These Terms shall be governed by and interpreted according to English Law and the parties submit to the exclusive jurisdiction of the English Courts.
